And justice for all? About Bl**dy time!
… Washington — The Supreme Court dealt U.S. President George W. Bush a stunning defeat Thursday, ruling the controversial military trials of terrorists suspects detained at Guantanamo prison camp were illegal under both U.S. and international law, including the Geneva Convention.
…
The vote was 5-3, with moderate Justice Anthony M. Kennedy joining the court’s liberal members in ruling against the Bush administration. Chief Justice John Roberts, named to the lead the court last September by Bush, was sidelined in the case because, as an appeals court judge that he had earlier ruled on the Hamdan case. … [1]
A bit of a reality check delivery.
… Both rulings reinforced the court’s warning in a related case two years ago. The president, it said, does not have a “blank check” for pursuing war against the nation’s enemies. Even in matters of national security, he must defer to checks and balances posed by other branches of government and the U.S. Constitution. … [2]
and …
For five years, President Bush waged war as he saw fit. If intelligence officers needed to eavesdrop on overseas telephone calls without warrants, he authorized it. If the military wanted to hold terrorism suspects without trial, he let it.
Now the Supreme Court has struck at the core of his presidency and dismissed the notion that the president alone can determine how to defend the country. In rejecting Bush’s military tribunals for terrorism suspects, the high court ruled that even a wartime commander in chief must govern within constitutional confines significantly tighter than this president has believed appropriate.. … [3]
So will we see War Crimes trials against the Bush Administration, now that it has been found that they do need to recognise Common Article 3 of the Geneva Conventions? Or are ‘War Crimes’ only prosecuted when it is *the terrorists*?
… Even more importantly for present purposes, the Court held that Common Article 3 of Geneva applies as a matter of treaty obligation to the conflict against Al Qaeda. That is the HUGE part of today’s ruling. The commissions are the least of it. This basically resolves the debate about interrogation techniques, because Common Article 3 provides that detained persons “shall in all circumstances be treated humanely,” and that “[t]o this end,” certain specified acts “are and shall remain prohibited at any time and in any place whatsoever”—including “cruel treatment and torture,” and “outrages upon personal dignity, in particular humiliating and degrading treatment.” This standard, not limited to the restrictions of the due process clause, is much more restrictive than even the McCain Amendment. See my further discussion here.
This almost certainly means that the CIA’s interrogation regime is unlawful, and indeed, that many techniques the Administation has been using, such as waterboarding and hypothermia (and others) violate the War Crimes Act (because violations of Common Article 3 are deemed war crimes). . … [5]

The Quarter Finals;it is now the business end of the tournament and there are, thankfully, only a few more sleepless nights!
SOCCEROOS coach Guus Hiddink led his players in a chorus of complaint about the controversial decision of Spanish referee Luis Medina Cantalejo to award the match-deciding penalty in the dying seconds against Italy.
Italian defender Fabio Grosso sprawled after a challenge from the man generally regarded as the Socceroos’ best-performed player during this tournament, Lucas Neill. Replays cast considerable doubt about whether Neill had made significant contact or whether Grosso had fallen into the challenge. The decision left Neill inconsolable in the dressing room and the rest of the Australian party devastated. [1]

The 28th June has been designated as a National Day of Community Protest against the new industrial relations laws by the ACTU and community organisations.

“Tens of thousands of people have joined rallies across Australia to protest against new industrial relations (IR) laws.” [1]

“Workers have flooded central Melbourne with a sea of colour and soccer chants during today’s rally against the Howard Government’s new workplace laws.” [2]

“Mr Beazley estimated the crowd at 150,000 and said they were the delegates of millions more Australians opposed to the workplace reforms.” [3]

“This is a battle for Australian families. It’s also a battle for basic dignity in the workplace.” (Kim Beazley) [4]

A bit of a new concept for this blog, but I thought I’d upload some sound bites of the protest so you can listen as well as see the photos.

One of the features that would have been good during this weekends caching was quick access to the GCA State RSS feeds to see what was happening via GPRs with a very light data feed. After some initial testing the RSS feeds came up blank

Thanks for that it seems that http://geocaching.com.au/xml/caches/au/vic.rss works, but the feed links from the top of the state pages http://geocaching.com.au/caches/gca/au/vic.rss do not.

Social isolation linked to web
The internet may be contributing to a long term decline in the social networks in the US, according to to a study that reveals fewer close ties are now shared with family and friends than twenty years ago.
A study conducted in 2004 was compared with data from 1985 by sociologists from Duke University and the University of Arizona, who discovered the number of close confidents listed by respondents had shrunk dramatically in the past two decades.
The study did not uncover any reasons for the social change, but based on other studies, the researchers speculated that contributing factors to the decline in social networks might include the increase number of hours that people spend at work and the influence of internet communication.

Serious Study: Immaturity Levels Rising [1]
Jennifer Viegas, Discovery NewsJune 23, 2006 —The adage “like a kid at heart” may be truer than we think, since new research is showing that grown-ups are more immature than ever.
Specifically, it seems a growing number of people are retaining the behaviors and attitudes associated with youth.
As a consequence, many older people simply never achieve mental adulthood, according to a leading expert on evolutionary psychiatry.
…
A “child-like flexibility of attitudes, behaviors and knowledge” is probably adaptive to the increased instability of the modern world, Charlton believes. Formal education now extends well past physical maturity, leaving students with minds that are, he said, “unfinished.”
…
Charlton added that since modern cultures now favor cognitive flexibility, “immature” people tend to thrive and succeed, and have set the tone not only for contemporary life, but also for the future, when it is possible our genes may even change as a result of the psychological shift.
…
Let’s first look at some definitions:
mature = having reached full natural growth or development (Google)
maturity = adulthood: the period of time in your life after your physical growth has stopped and you are fully developed (Google)
immature = characteristic of a lack of maturity (Google)
